1.2 Account Creation:

• You must create an account to access our financial services
• You are responsible for maintaining the confidentiality of your login credentials
• You must immediately notify us of any unauthorized account access at support@kpentag.com
• We reserve the right to suspend or terminate accounts that provide false information

1.3 Identity Verification:

• You agree to provide valid identification documents when requested
• We may conduct background checks and verification procedures
• Failure to verify identity may result in account suspension

K-Pentag Digital provides the following financial technology services:

2.1 Service Availability:

• Services are subject to availability and may be modified or discontinued at our discretion
• We are not responsible for service interruptions beyond our reasonable control

3.1 Prohibited Activities: You agree not to:

• Use our services for any illegal purposes or violate any laws in Ghana or other jurisdictions

• Interfere with the security, integrity, or performance of our services
• Use our services for any high-risk activities without our prior written consent
• Reverse engineer, decompile, or disassemble any aspect of our services

3.2 Compliance with Laws:

• You must comply with all applicable laws, including anti-money laundering regulations
• You are responsible for any taxes arising from your use of our services
• You must not violate any export control or sanctions regulations

4.1 Fee Structure:

• All applicable fees are disclosed before transaction confirmation
• Fees are subject to change with 30 days' prior notice
• You authorize us to deduct fees directly from your transactions
• Chargebacks may incur additional processing fees

4.2 Payment Authorization:

• You authorize us to process payments according to your instructions
• We are not responsible for errors in payment instructions provided by you
• Transactions may be delayed or refused for security or compliance reasons

4.3 Currency Conversion:

• Currency conversion rates are determined by market rates and include our margin
• Exchange rates are not guaranteed until transaction completion

5.1 Our Intellectual Property:

• All content, trademarks, logos, and software on our platform are the exclusive property of K-Pentag Digital or our licensors
• The "K-Pentag Digital" name and logo are registered trademarks
• Our website content, design, and technology are protected by copyright and other intellectual property laws

5.2 Limited License:

• We grant you a limited, non-exclusive, non-transferable license to use our services for personal or business use
• You may not copy, modify, distribute, or create derivative works without our express written permission
• All rights not expressly granted are reserved

5.3 User Content:

• You retain ownership of content you submit to our platform
• You grant us a license to use your content to provide our services

We protect your personal data in accordance with our Privacy Policy and applicable data protection laws, including Ghana's Data Protection Act.

• Compliance and verification documents

7.1 No Warranties:

• Our services are provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service

7.2 Limitation of Liability:

• To the maximum extent permitted by law, our total liability shall not exceed the fees you paid to us in the past 6 months
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for losses caused by events beyond our reasonable control

8.1 Termination Rights:

• You may terminate your account at any time by contacting support@kpentag.com
• We may suspend or terminate your account for violation of these Terms
• We may suspend accounts for security reasons or suspected fraudulent activity

8.2 Effects of Termination:

• Your right to use our services immediately ceases upon termination
• Outstanding fees remain payable
• We may retain your information as required by law or for legitimate business purposes

9.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Ghana.

9.2 Dispute Resolution:

• Parties shall attempt to resolve disputes amicably through negotiation
• Unresolved disputes shall be referred to mediation in Accra, Ghana
• If mediation fails, disputes shall be resolved through arbitration in accordance with Ghanaian law

9.3 Class Action Waiver: You waive any right to participate in class actions or representative proceedings.

10.1 Modification Rights: We reserve the right to modify these Terms at any time.

10.2 Notification: We will provide 30 days' notice of material changes via email or platform notification.

10.3 Continued Use: Your continued use of our services after changes constitutes acceptance of the modified Terms.
